Terms of Service

1. Who we are

Fyber One Limited ("Fyber One", "we", "us") is a Jamaican software company. We design and engineer web and mobile applications for clients, and we build and operate our own software products, including Logicware, a courier and freight operations platform.

2. Scope of these terms

These terms cover four things:

• your use of this website (fyber.one);
• engagement of our software design and development services;
• use of Logicware by courier and freight operators; and
• payments for courier package charges collected by Fyber One.

Individual client engagements and Logicware operator agreements are governed by their own signed contracts; where a signed contract exists, it prevails over these terms.

3. Development services

Proposals, statements of work, and quotes we issue are valid for the period stated on them. Unless a signed agreement says otherwise: work is billed as scoped in the applicable statement of work; intellectual property in bespoke deliverables transfers to the client on full payment, excluding our pre-existing tools, libraries, and platforms; and each party keeps the other's non-public information confidential.

4. Logicware

Logicware is provided to courier and freight operators under an operator agreement. Operators are responsible for the accuracy of shipment data, charges, and customer communications they issue through the platform. We are responsible for operating the platform with reasonable skill and care.

5. Package payments

Where a courier's customers pay shipping, customs, or handling charges online through Logicware, Fyber One is the merchant of record for those card transactions. The charge on your statement will be from Fyber One. Refunds and disputes for these payments are handled under our Refund Policy. Physical storage and delivery of packages is performed by the courier, not by Fyber One.

6. Acceptable use of this website

Don't attempt to disrupt, probe, or gain unauthorised access to this website or the systems behind it; don't use it to transmit unlawful content; and don't misrepresent your identity when contacting us or making a payment.

7. Intellectual property

The content, design, and branding of this website, and of Fyber One and Logicware products, belong to Fyber One Limited or its licensors. You may not reproduce them without permission, beyond what normal browsing requires.

8. Liability

This website is provided "as is". To the maximum extent permitted by law, we are not liable for indirect or consequential loss arising from use of this website. For services and products, our liability is as set out in the applicable signed agreement. Nothing in these terms excludes liability that cannot be excluded under Jamaican law.

9. Changes

We may update these terms from time to time. The "last updated" date above reflects the current version; material changes to how payments are handled will also be reflected in the Refund Policy.
