Fyber provides payment processing services that enable merchants to accept credit card payments, manage subscriptions, and handle related financial transactions. Our services include:
- Payment processing and authorization
- Subscription and recurring billing management
- Payment links and hosted checkout pages
- Merchant dashboard and reporting tools
- APIs and developer tools for integration
3. Account Registration
To use our services, you must register for an account and provide accurate, complete, and current information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
- Ensuring your business information remains up to date
4. Acceptable Use
You agree not to use our services for any unlawful purpose or in any way that could damage, disable, or impair our services. Prohibited activities include:
- Processing payments for illegal goods or services
- Fraudulent or deceptive business practices
- Money laundering or terrorist financing
- Violation of card network rules
- Unauthorized access to our systems
5. Fees and Payment
You agree to pay all fees associated with your use of our services as described in our pricing page. Fees may include:
- Transaction processing fees
- Monthly or annual subscription fees
- Chargeback and dispute fees
- Additional service fees as applicable
We reserve the right to modify our fees with 30 days notice. Continued use of our services after fee changes constitutes acceptance of the new fees.
6. Settlements and Payouts
We will settle funds to your designated bank account according to the settlement schedule for your account tier. Settlement timing may vary based on:
- Your account verification status
- Transaction risk assessment
- Bank processing times
- Reserve requirements
7. Chargebacks and Disputes
You are responsible for all chargebacks, disputes, and refunds related to your transactions. You agree to:
- Respond to chargeback inquiries promptly
- Provide documentation to support disputes
- Maintain adequate reserves for potential chargebacks
- Comply with card network dispute resolution procedures
8. Data Security
We maintain PCI DSS compliance and implement industry-standard security measures. However, you are responsible for:
- Securing your integration and API credentials
- Not storing sensitive cardholder data
- Complying with applicable data protection laws
- Reporting security incidents promptly
9. Limitation of Liability
To the maximum extent permitted by law, Fyber shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
10. Termination
Either party may terminate this agreement at any time with written notice. Upon termination:
- Access to services will be suspended
- Outstanding fees remain due
- Reserves may be held for chargeback protection
- Data will be retained as required by law
11. Governing Law
These terms shall be governed by and construed in accordance with the laws of Jamaica, without regard to its conflict of law provisions.
12. Changes to Terms
We reserve the right to modify these terms at any time. We will notify you of any changes by posting the new terms on this page and updating the "Last updated" date.
